Terms of Service

Overview

By creating an account or using Replate (the "App"), you agree to these Terms of Service. If you do not agree, do not use the App.

1. The Service

Replate generates personalised meal plans and nutrition information using artificial intelligence, based on data you provide. Meal plans are produced by an automated AI system (large language model) and are not reviewed or verified by a human nutritionist or dietitian. Features and content may change over time.

2. Not Medical Advice

The App provides general nutrition information only and is not medical or dietary advice. See our Health & Nutrition Disclaimer, which is incorporated into these Terms. You use the App and any plan at your own risk and should consult a qualified professional before changing your diet. Always verify ingredients and allergens yourself.

3. Eligibility & Accounts

You must be at least 18 years old to use the App. By creating an account, you confirm you are 18 or over. You are responsible for your account credentials and for all activity under your account. Provide accurate information.

4. Acceptable Use

You agree not to: misuse or attempt to disrupt the App or its infrastructure; access it by automated means or scrape content; reverse-engineer it; or use it for any unlawful purpose. We may apply usage limits (e.g. on AI-generated plans) and may suspend accounts that abuse the service, with reasonable prior notice except where the breach is serious (e.g. illegal activity or security threats).

5. Subscriptions & Payments

Some features require a paid subscription billed through the Apple App Store or Google Play.

Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period; manage or cancel in your device's store account settings.
Prices, billing frequency, and included features are shown at the point of purchase.
Price changes: If we change subscription prices, we will notify existing subscribers in advance. You may cancel before the new price takes effect.
Refunds are handled per the applicable app store's refund policy.

EU/EEA users — right of withdrawal: Under EU consumer law (Directive 2011/83/EU), you have a 14-day right to withdraw from this contract from the date of purchase. However, by choosing to start using the App immediately after purchase, you expressly request that service delivery begins before the 14-day period expires, and you acknowledge that you thereby lose your right of withdrawal once delivery has commenced. If you have not used the service within 14 days of purchase, email replateai@gmail.com to request a withdrawal and refund.

6. Intellectual Property

The App, its design, and its content are owned by Szymon Tabiś or its licensors. Recipe and meal data may be sourced or AI-generated; we grant you a personal, non-transferable, non-exclusive licence to use the App for your personal, non-commercial use only.

7. User Data

Our handling of your data is described in the Privacy Policy. You retain rights to the personal information you provide.

8. Disclaimers & Limitation of Liability

The App is provided "as is" without warranties of any kind. To the maximum extent permitted by law:

Szymon Tabiś is not liable for indirect, incidental, or consequential damages, or for any harm arising from reliance on AI-generated nutrition information or meal plans.
Our total liability for any claim arising from your use of the App shall not exceed the greater of (a) the total amount you paid for the App in the 12 months preceding the claim, or (b) €50.
Nothing in these Terms limits or excludes liability that cannot be excluded under applicable law, including your statutory consumer rights under EU and Polish law.

9. Termination

You may stop using the App and delete your account at any time (Settings → Account). We may suspend or terminate access for material breach of these Terms, with reasonable prior notice where possible.

10. Changes

We may update these Terms. Material changes will be notified in-app at least 14 days before taking effect. Continued use after changes means you accept them.

11. Governing Law & Disputes

These Terms are governed by the laws of Poland, without prejudice to mandatory consumer protections in your country of residence. Nothing in these Terms limits your rights under applicable Polish or EU consumer protection law.
